AGREEMENT FOR DESIGN

AND CONSULTING SERVICES BETWEEN:

A.  Design Services

The Contractor’s design services during the course of the Project consist generally of the following:

 

1.     Consulting with Client to determine the scope of work and budget considerations.  At this point in time, Client’s estimated construction budget is $_______________.  This budget is not a guarantee but is used to help shape the Project scope and product recommendations.  Client may choose to change this budget as drawings, details and estimates are developed and considered.

2.     As needed, securing and supervising design related subcontractors such as an architect, engineer, or other specialists pertinent to scope of the Project.

3.     Conducting, as needed, preliminary studies such as measuring the existing structure; taking photographs; soil testing, etc.

4.     Planning and drawing floor plans, elevations and perspectives, lighting and plumbing fixture locations, considering and possibly drawing furniture arrangement.

5.     Helping with selection of any necessary cabinetry, appliances, light fixtures, plumbing fixtures, and finishes such as counter tops, flooring, paint colors, etc., for Client approval.  At Client’s request, Contractor’s Project Designer or Design Coordinator will visit showrooms with Client and help Client coordinate the selections.

6.     Developing specifications, meeting with construction subcontractors at Client’s home for subcontractor pricing, and preparing cost estimates for budget feasibility during the design development phase. 

7.     Preparing working drawings and, at Client’s request, take the necessary steps to acquire a building permit for the Project in the appropriate municipal jurisdiction.

8.   Design consultation as Client needs during construction of the Project.

B. Fees and Payment Provisions

Estimated overall cost to Client for professional design services, excluding building permit acquisition and fees, generally runs in the range of 5% to 8% of the cost to construct the project.  Many elements can influence that range higher or lower such as the type of space being remodeled, product research, Client’s individual needs, engineering, building department requirements, etc.  Given Client’s current estimated budget $____________, the estimated design fees are likely to range between $_____________ and $____________.

 

The Client agrees to pay a fee of $100 per hour for Contractor’s Project Designer or Design Coordinator, and cost plus 10% on any necessary subcontractors (e.g. architect, engineer…), document reproduction, and mailing for above listed services. 

Payment of fees will be as follows:

1.     Initial retainer of $750 shall be paid upon signed acceptance of this Agreement.   The retainer will be applied toward the initial services.

2.   Remaining fees will be billed biweekly.

3.     If Contractor’s Design Coordinator and Project Designer meet with Owner for design review at the same time, Contractor will only bill for the Project Designer.

 

C.  Terms and Conditions

                       

1.   Client may terminate the design and consultation services at any time with written       notice to Contractor and payment for all professional services up to the date of         Contractor’s receipt of the notice. 

2.   Client will receive drawings throughout the design process, however, designs and         drawings will remain as the property of Contractor until clearing of the final       payment on the final construction contract.  Plans are for documentation purposes         only and are not to be relied upon for construction except by Contractor.  No warranty is expressed or implied as to suitability for any other’s use. 

3.   If Client needs design consultation after            construction has commenced, design      services will be billed at the rates described in B. above.

4.   Client grants permission for Contractor to utilize photographs of the Project for      

      general use such as award entry or on Contractor’s web site.

5.   Invoices are payable within 10 days of receipt.  Balances unpaid after 30 days are          subject to an interest charge of 1% per month, billed on a weekly basis.

6.   Agreement is hereby accepted to the services as outlined above.

Right of Rescission

 

 

You may cancel this contract, without any penalty or obligation, within three (3) business days from the above date. If you cancel, any property traded in, any payments made by you under the contract of sale, and any negotiable instrument executed by you will be returned within ten (10) business days following receipt by the Contractor of your cancellation notice, and any security interest arising out of the contract will be canceled.

 

If you cancel, you must make available to the Contractor at your residence, in substantially as good as when received, any goods delivered to you under this contract of sale; or you may, if you wish, comply with the instruction of the Contractor regarding the return shipment of the goods at the Contractor’s expense and risk.

 

If you do make the goods available to the Contractor and the Contractor does not pick them up within twenty (20) days of the date of your Notice of Cancellation, you may retain or dispose of the goods without any further obligation.  If you fail to make the goods available to the Contractor, or if you agree to return the goods to the Contractor and fail to do so, then you remain liable for those goods.
